D\u00e1le ji ovliv\u0148uje nap\u0159\u00edklad <strong>katastr\u00e1ln\u00ed z\u00e1kon \u010d. 256\/2013 Sb.<\/strong>, kter\u00fd upravuje z\u00e1pisy do katastru nemovitost\u00ed, a tak\u00e9 <strong>z\u00e1kon o hospoda\u0159en\u00ed energi\u00ed \u010d. 406\/2000 Sb.<\/strong>, kter\u00fd stanovuje povinnost dolo\u017eit <strong>energetick\u00fd \u0161t\u00edtek<\/strong> (PENB).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"htoc-mus-m-t-kupn-smlouva-n-jakou-speci-ln-formu-kolik-kopi-je-pot-eba\"><strong>Mus\u00ed m\u00edt kupn\u00ed smlouva n\u011bjakou speci\u00e1ln\u00ed formu? Kolik kopi\u00ed je pot\u0159eba?<\/strong><\/h2>\n\n\n\n<p>Ano, kupn\u00ed smlouva mus\u00ed m\u00edt v\u017edy p\u00edsemnou formu \u2013 <strong>\u00fastn\u00ed dohoda v tomto p\u0159\u00edpad\u011b neplat\u00ed.<\/strong> Doporu\u010duji vyhotovit smlouvu v tolika origin\u00e1lech, kolik je \u00fa\u010dastn\u00edk\u016f. Ka\u017ed\u00fd kupuj\u00edc\u00ed i prod\u00e1vaj\u00edc\u00ed mus\u00ed m\u00edt sv\u016fj origin\u00e1l. Pokud kupuj\u00edc\u00ed financuje nemovitost <a href=\"https:\/\/www.fingo.cz\/hypotecni-kalkulacka\">hypot\u00e9kou<\/a>, jeden v\u00fdtisk v\u010detn\u011b p\u0159\u00edloh pot\u0159ebuje i banka. Katastru dodejte origin\u00e1l nebo \u00fa\u0159edn\u011b ov\u011b\u0159enou kopii. Podpisy na t\u00e9to verzi mus\u00edte nechat \u00fa\u0159edn\u011b ov\u011b\u0159it. Pro banku obvykle sta\u010d\u00ed neov\u011b\u0159en\u00e9 podpisy, nebo ov\u011b\u0159en\u00ed provede pov\u011b\u0159en\u00fd zam\u011bstnanec banky \u010di realitn\u00ed makl\u00e9\u0159. Pokud smlouvu sep\u00ed\u0161e not\u00e1\u0159, ov\u011b\u0159uje podpisy automaticky.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"htoc-mnoho-lid-si-st-hne-vzor-kupn-smlouvy-z-internetu-pro-to-nen-dobr-n-pad\"><strong>Mnoho lid\u00ed si st\u00e1hne vzor kupn\u00ed smlouvy z internetu. Pro\u010d to nen\u00ed dobr\u00fd n\u00e1pad?<\/strong><\/h2>\n\n\n\n<p><strong>Vzory kupn\u00edch smluv<\/strong> z internetu \u010dasto neobsahuj\u00ed v\u0161echny n\u00e1le\u017eitosti, kter\u00e9 vy\u017eaduje z\u00e1kon. M\u016f\u017ee chyb\u011bt nap\u0159\u00edklad p\u0159esn\u00e1 definice <strong>v\u011bcn\u00fdch b\u0159emen<\/strong>, informace o p\u0159\u00edpadn\u00fdch <strong>exekuc\u00edch<\/strong>, <strong>podm\u00ednky p\u0159evodu<\/strong> nebo <strong>sankce za nespln\u011bn\u00ed smlouvy<\/strong>. Takov\u00e1 smlouva m\u016f\u017ee b\u00fdt neplatn\u00e1 nebo ji katastr odm\u00edtne zapsat. Nav\u00edc nikdo neru\u010d\u00ed za jej\u00ed spr\u00e1vnost. Doporu\u010duji sv\u011b\u0159it seps\u00e1n\u00ed smlouvy not\u00e1\u0159i nebo advok\u00e1tovi, kter\u00fd ru\u010d\u00ed za jej\u00ed obsah a dok\u00e1\u017ee p\u0159edej\u00edt budouc\u00edm spor\u016fm.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"htoc-co-v-echno-mus-kupn-smlouva-obsahovat-na-co-si-d-t-pozor\"><strong>Co v\u0161echno mus\u00ed kupn\u00ed smlouva obsahovat? Na co si d\u00e1t pozor?<\/strong><\/h2>\n\n\n\n<p>Ka\u017ed\u00e1 kupn\u00ed smlouva mus\u00ed obsahovat <strong>p\u0159esnou identifikaci obou stran<\/strong> \u2013 jm\u00e9no, datum narozen\u00ed, rodn\u00e9 \u010d\u00edslo, adresu, p\u0159\u00edpadn\u011b I\u010cO u pr\u00e1vnick\u00e9 osoby. Ve smlouv\u011b mus\u00edte detailn\u011b popsat <strong>p\u0159edm\u011bt koup\u011b<\/strong> podle \u00fadaj\u016f z katastru: katastr\u00e1ln\u00ed \u00fazem\u00ed, \u010d\u00edslo parcely, \u010d\u00edslo nemovitosti. U bytu je pot\u0159eba uv\u00e9st i <strong>\u010d\u00edslo bytov\u00e9 jednotky<\/strong> a <strong>pod\u00edl na spole\u010dn\u00fdch \u010d\u00e1stech domu<\/strong>.<\/p>\n\n\n\n<p>Smlouva mus\u00ed obsahovat <strong>kupn\u00ed cenu, zp\u016fsob jej\u00ed \u00fahrady a term\u00edn zaplacen\u00ed.<\/strong> Pokud pen\u00edze skl\u00e1d\u00e1te do not\u00e1\u0159sk\u00e9 \u00faschovy nebo na v\u00e1zan\u00fd \u00fa\u010det, nezapome\u0148te to do smlouvy tak\u00e9 uv\u00e9st. D\u016fle\u017eit\u00e9 je <strong>prohl\u00e1\u0161en\u00ed, \u017ee na nemovitosti nev\u00e1znou z\u00e1stavy<\/strong> (krom\u011b z\u00e1stavn\u00edho pr\u00e1va p\u016fvodn\u00ed banky a novou hypot\u00e9kou p\u0159ejde z\u00e1stavn\u00ed pr\u00e1vo na novou banku), nen\u00ed zat\u00ed\u017eena exekuc\u00ed ani jin\u00fdm omezen\u00edm. Pokud existuj\u00ed <strong>v\u011bcn\u00e1 b\u0159emena<\/strong>, mus\u00edte je v kupn\u00ed smlouv\u011b v\u00fdslovn\u011b uv\u00e9st.<\/p>\n\n\n\n<p>Je pot\u0159eba tak\u00e9 p\u0159esn\u011b stanovit, <strong>kdy dojde k p\u0159evodu vlastnick\u00e9ho pr\u00e1va<\/strong> \u2013 nap\u0159\u00edklad po proveden\u00ed vkladu do katastru nemovitost\u00ed. Doporu\u010duji tak\u00e9 do smlouvy zahrnout <strong>sankce pro p\u0159\u00edpad nespln\u011bn\u00ed povinnost\u00ed,<\/strong> nap\u0159\u00edklad pokutu za prodlen\u00ed.<\/p>\n\n\n\n<p class=\"has-very-light-gray-to-cyan-bluish-gray-gradient-background has-background\">\ud83e\udef0 Vyplat\u00ed se v\u00e1m <a href=\"https:\/\/www.fingo.cz\/blog\/najem-nebo-hypoteka-co-se-vyplati\/\">n\u00e1jem nebo hypot\u00e9ka<\/a>?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"htoc-jak-m-b-t-definovan-p-edm-t-smlouvy-byt-nebo-d-m\"><strong>Jak d<\/strong>efinovat<strong> p\u0159edm\u011bt smlouvy \u2013 byt nebo d\u016fm?<\/strong><\/h2>\n\n\n\n<p><strong>Byt<\/strong> popi\u0161te podle <strong>\u010d\u00edsla jednotky, listu vlastnictv\u00ed, katastr\u00e1ln\u00edho \u00fazem\u00ed, v\u010detn\u011b pod\u00edlu na spole\u010dn\u00fdch \u010d\u00e1stech domu<\/strong>. Uv\u00e1d\u00ed se tak\u00e9 p\u0159\u00edslu\u0161enstv\u00ed, jako je <strong>sklep, balkon, lod\u017eie nebo gar\u00e1\u017eov\u00e9 st\u00e1n\u00ed, a jejich rozm\u011bry<\/strong>. U rodinn\u00e9ho domu uve\u010fte <strong>\u010d\u00edslo popisn\u00e9, parceln\u00ed \u010d\u00edslo, p\u0159ipojen\u00ed na in\u017een\u00fdrsk\u00e9 s\u00edt\u011b<\/strong>, p\u0159\u00edpadn\u011b <strong>v\u011bcn\u00e1 b\u0159emen<\/strong>a, nap\u0159\u00edklad pr\u00e1vo ch\u016fze nebo j\u00edzdy po p\u0159\u00edjezdov\u00e9 cest\u011b. <strong>D\u016fm mus\u00ed m\u00edt zaji\u0161t\u011bn\u00fd p\u0159\u00edstup, jinak ho banka nemus\u00ed akceptovat jako z\u00e1stavu.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"htoc-m-b-t-v-kupn-smlouv-uvedeno-i-vybaven-jako-je-kuchy-sk-linka-nebo-vestav-n-sk-n\"><strong>J<\/strong>e dobr\u00e9 v<strong> kupn\u00ed smlouv\u011b uv\u00e9<\/strong>st<strong> i vybaven\u00ed?<\/strong><\/h2>\n\n\n\n<p>Vestav\u011bn\u00e9 vybaven\u00ed nen\u00ed povinnou sou\u010d\u00e1st\u00ed kupn\u00ed smlouvy, ale doporu\u010duji ho uv\u00e9st. Jinak m\u016f\u017ee doj\u00edt ke sporu. Pokud ob\u011b strany souhlas\u00ed, lze vybaven\u00ed vy\u010d\u00edslit a uv\u00e9st jako sou\u010d\u00e1st kupn\u00ed smlouvy, p\u0159\u00edpadn\u011b samostatn\u00fdm dodatkem. <strong>Sklep nebo gar\u00e1\u017eov\u00e9 st\u00e1n\u00ed t<\/strong>ak\u00e9 uve\u010fte<strong> v kupn\u00ed smlouv\u011b v\u017edy<\/strong>, proto\u017ee jsou samostatn\u00fdmi jednotkami zapsan\u00fdmi v katastru.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"htoc-co-hroz-kdy-je-p-edm-t-koup-pops-n-patn\"><strong>Co hroz\u00ed, kdy\u017e p\u0159edm\u011bt koup\u011b pop\u00ed\u0161i \u0161patn\u011b?<\/strong><\/h2>\n\n\n\n<p><strong>Pokud je nemovitost ve smlouv\u011b chybn\u011b pops\u00e1na, m\u016f\u017ee katastr odm\u00edtnout vklad vlastnick\u00e9ho pr\u00e1va. <\/strong>To znamen\u00e1 nov\u00e9 poplatky za pod\u00e1n\u00ed, zpo\u017ed\u011bn\u00ed p\u0159evodu, nutnost dodatku ke smlouv\u011b a zdr\u017een\u00ed \u010derp\u00e1n\u00ed <a href=\"https:\/\/www.fingo.cz\/hypotecni-kalkulacka\">hypot\u00e9ky<\/a>. M\u016f\u017ee se st\u00e1t, \u017ee banka zastav\u00ed schvalov\u00e1n\u00ed \u00fav\u011bru nebo \u017ee nebude mo\u017en\u00e9 vlo\u017eit ani z\u00e1stavn\u00ed smlouvu. Chybn\u00e9 \u00fadaje mohou m\u00edt vliv i na poji\u0161t\u011bn\u00ed, dotace, v\u00fd\u0161i dan\u011b a dokonce ohrozit samotn\u00fd prodej.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"htoc-jak-ve-smlouv-upravit-kupn-cenu-a-jej-hradu\"><strong>Jak ve smlouv\u011b upravit kupn\u00ed cenu a jej\u00ed \u00fahradu?<\/strong><\/h2>\n\n\n\n<p>Kupn\u00ed cena mus\u00ed b\u00fdt uvedena <strong>\u010d\u00edseln\u011b i slovn\u011b<\/strong>. Mus\u00ed b\u00fdt stanoven jasn\u00fd <strong>term\u00edn \u00fahrady<\/strong> \u2013 ke konkr\u00e9tn\u00edmu datu nebo nap\u0159\u00edklad do 15 dn\u016f od doru\u010den\u00ed rozhodnut\u00ed o vkladu vlastnick\u00e9ho pr\u00e1va. Pokud je platba rozlo\u017eena na v\u00edce \u010d\u00e1st\u00ed, mus\u00ed b\u00fdt uvedeny v\u0161echny term\u00edny. V\u017edy mus\u00ed b\u00fdt specifikov\u00e1no <strong>\u010d\u00edslo \u00fa\u010dtu<\/strong>, na kter\u00fd m\u00e1 b\u00fdt platba provedena. Pokud doch\u00e1z\u00ed k \u00fahrad\u011b p\u0159es not\u00e1\u0159skou \u00faschovu nebo v\u00e1zan\u00fd \u00fa\u010det, mus\u00ed smlouva obsahovat i tyto informace.<\/p>\n\n\n\n<p class=\"has-very-light-gray-to-cyan-bluish-gray-gradient-background has-background\">\ud83c\udfe1 Jak na novou hypot\u00e9ku?
