V roce 2023 se podle \u010cS\u00da rozvedlo celkem 19,5 tis\u00edce man\u017eelstv\u00ed. Banka p\u0159i \u017e\u00e1dosti o hypot\u00e9ku prov\u011b\u0159uje finan\u010dn\u00ed stabilitu obou man\u017eel\u016f a jejich kreditn\u00ed sk\u00f3re. Na z\u00e1klad\u011b toho ur\u010d\u00ed podm\u00ednky hypot\u00e9ky.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u0159i koupi nemovitosti v katastru zap\u00ed\u0161\u00ed <strong>pom\u011br, v jak\u00e9m partne\u0159i nemovitost vlastn\u00ed<\/strong>. V man\u017eelstv\u00ed vlastn\u00edte nemovitost v r\u00e1mci spole\u010dn\u00e9ho jm\u011bn\u00ed man\u017eel\u016f<strong> <\/strong>(tzv. SJM) 50:50. U nesezdan\u00fdch partner\u016f se do katastru zap\u00ed\u0161e <strong>procentu\u00e1ln\u00ed pod\u00edl,<\/strong> na kter\u00e9m se partne\u0159i p\u0159i koupi nemovitosti dohodli.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pokud na hypot\u00e9ku vyd\u011bl\u00e1v\u00e1 p\u0159ev\u00e1\u017en\u011b jeden z v\u00e1s, doporu\u010dujeme, aby m\u011bl dobr\u00e9 <strong>\u017eivotn\u00ed poji\u0161t\u011bn\u00ed<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"htoc-vlastn-nastaven-pravidel\"><strong>Vlastn\u00ed nastaven\u00ed pravidel<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Pokud v\u00e1m nevyhovuje z\u00e1konn\u00e9 pojet\u00ed SJM, m\u016f\u017eete si nastavit vlastn\u00ed pravidla hry. Jednou mo\u017enost\u00ed je <strong>p\u0159edman\u017eelsk\u00e1 smlouva<\/strong>, kter\u00e1 uprav\u00ed vlastnictv\u00ed nemovitosti a spl\u00e1cen\u00ed hypot\u00e9ky.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dal\u0161\u00edm zp\u016fsobem, kter\u00fd m\u016f\u017eete vyu\u017e\u00edt a\u017e b\u011bhem trv\u00e1n\u00ed man\u017eelstv\u00ed, je p\u0159ed pod\u00e1n\u00edm \u017e\u00e1dosti o hypot\u00e9ku sepsat u not\u00e1\u0159e <strong>Z\u00e1pis o z\u00fa\u017een\u00e9m jm\u011bn\u00ed man\u017eel\u016f<\/strong>. S t\u00edm mus\u00ed oba man\u017eel\u00e9 souhlasit. T\u00edm si nastav\u00edte hranice sv\u00fdch z\u00e1vazk\u016f, nemovitost po\u0159\u00edd\u00edte mimo SJM a jen jeden z v\u00e1s bude jej\u00edm vlastn\u00edkem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">T\u00edm p\u00e1dem dolo\u017e\u00edte bance bonitu jen jednoho z man\u017eel\u016f a \u00fav\u011brovou smlouvu podep\u00ed\u0161e jen jeden z v\u00e1s.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"htoc-kdy-se-nemus-p-i-rozvodu-vypl-cet-partner-z-hypot-ky\"><strong>Kdy se nemus\u00ed p\u0159i rozvodu vypl\u00e1cet partner z hypot\u00e9ky?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Pokud si jeden z v\u00e1s vzal hypot\u00e9ku je\u0161t\u011b <strong>p\u0159ed uzav\u0159en\u00edm man\u017eelstv\u00edm<\/strong>, rozvod na ni, ani na vlastnictv\u00ed nemovitosti nem\u00e1 \u017e\u00e1dn\u00fd vliv. Takov\u00e1 nemovitost toti\u017e nen\u00ed sou\u010d\u00e1st\u00ed SJM.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u0159i rozvodu by se \u0159e\u0161ilo vypo\u0159\u00e1d\u00e1n\u00ed jen v p\u0159\u00edpad\u011b, kdy partner, kter\u00fd nemovitost nevlastn\u00ed, finan\u010dn\u011b p\u0159isp\u011bl nap\u0159\u00edklad na jej\u00ed rekonstrukci. Pak by m\u011bl b\u00fdt vlastn\u00edkem nemovitosti vyplacen \u010d\u00e1stkou, kterou do nemovitosti vlo\u017eil.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"htoc-jak-se-dohodnout-na-cen-pod-lu\"><strong>Jak se dohodnout na cen\u011b pod\u00edlu?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Aby bylo vypo\u0159\u00e1d\u00e1n\u00ed spravedliv\u00e9, tak se p\u0159i rozd\u011blov\u00e1n\u00ed nemovitosti zohled\u0148uje jak <strong>p\u016fvodn\u00ed investice<\/strong> ka\u017ed\u00e9ho z v\u00e1s, tak <strong>sou\u010dasn\u00e1 tr\u017en\u00ed hodnota nemovitosti<\/strong>. Vzhledem k dlouhodob\u00e9mu r\u016fstu cen nemovitost\u00ed se m\u016f\u017ee st\u00e1t, \u017ee tyto \u010d\u00e1stky se budou zna\u010dn\u011b li\u0161it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kombinace t\u011bchto dvou \u010d\u00e1stek umo\u017e\u0148uje <strong>spravedliv\u00e9 vypo\u0159\u00e1d\u00e1n\u00ed pod\u00edl\u016f<\/strong>. Cel\u00e1 hypot\u00e9ka pak z\u016fstane jen na n\u011bm.<\/li>\n\n\n\n<li id=\"htoc-nem-te-na-to-pen-ze-pokud-chcete-partnera-vyplatit-a-nem-te-dostatek-spor-budete-si-muset-bu-nav-it-st-vaj-c-hypot-ku-o-stku-kterou-budete-pot-ebovat-k-vyplacen-nebo-hypot-ku-refinancovat-k-jin-bance-kde-si-vezmete-novou-jak-na-nesplacenou-st-nemovitosti-tak-na-stku-k-vypo-d-n-partnera\"><strong>Nem\u00e1te na to pen\u00edze: <\/strong>pokud chcete partnera vyplatit a nem\u00e1te dostatek \u00faspor, budete si muset bu\u010f nav\u00fd\u0161it st\u00e1vaj\u00edc\u00ed hypot\u00e9ku o \u010d\u00e1stku, kterou budete pot\u0159ebovat k vyplacen\u00ed nebo hypot\u00e9ku refinancovat k jin\u00e9 bance, kde si vezmete novou jak na nesplacenou \u010d\u00e1st nemovitosti, tak na \u010d\u00e1stku k vypo\u0159\u00e1d\u00e1n\u00ed partnera.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">V obou p\u0159\u00edpadech po\u010d\u00edtejte s t\u00edm, \u017ee banka prov\u011b\u0159\u00ed, zda \u00fav\u011br jeden partner zvl\u00e1dne s\u00e1m a m\u00e1 na to dostate\u010dn\u00fd p\u0159\u00edjem. A\u017e pak vyplacen\u00e9ho partnera z hypot\u00e9ky vyv\u00e1\u017ee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">M\u016f\u017ee nastat je\u0161t\u011b dal\u0161\u00ed situace, a to v p\u0159\u00edpad\u011b, \u017ee <strong>nemovitost si nechce ponechat ani jeden z partner\u016f<\/strong>, nemaj\u00ed na vz\u00e1jemn\u00e9 vypo\u0159\u00e1d\u00e1n\u00ed nebo nejsou schopni se dohodnout. Ob\u011bma v\u00e1m tak vznik\u00e1 tak\u00e9 <strong>n\u00e1rok na rovn\u00fd pod\u00edl na zaplacen\u00fdch spl\u00e1tk\u00e1ch<\/strong> bez ohledu na to, kdo na spl\u00e1tky vyd\u011bl\u00e1val.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u010c\u00e1stku zaplacen\u00fdch spl\u00e1tek si pak rozd\u011bl\u00edte mezi v\u00e1s oba rovn\u00fdm d\u00edlem a p\u0159i rozvodu ur\u010d\u00edte, jak zohledn\u00edte tyto ji\u017e zaplacen\u00e9 spl\u00e1tky v celkov\u00e9m vypo\u0159\u00e1d\u00e1n\u00ed majetku.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"htoc-p-klad-vyplacen-hypot-ky-v-ji-zaplacen-ch-spl-tek\"><strong>P\u0159\u00edklad vyplacen\u00ed hypot\u00e9ky v\u010d. ji\u017e zaplacen\u00fdch spl\u00e1tek<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">P\u0159edpokl\u00e1dejme, \u017ee b\u011bhem man\u017eelstv\u00ed jste na hypot\u00e9ku <strong>zaplatili 500 000 K\u010d<\/strong>. Rozv\u00e1d\u00edte se v situaci, kdy <strong>tr\u017en\u00ed hodnota nemovitosti je 3 000 000 K\u010d,<\/strong> p\u0159i\u010dem\u017e <strong>zb\u00fdvaj\u00edc\u00ed hypot\u00e9ka je 1 500 000 K\u010d<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Man\u017eelka chce z\u016fstat v dom\u011b a p\u0159evz\u00edt hypot\u00e9ku.
